  • CWA Sec 401 Water Quality Certification CO

    Colorado Department of Public Health and Environment Section 401, Clean Water Act - Water Quality Certification. This regulation applies to: Permits issued to construct or operate a facility by the U.S. Army Corps of Engineers pursuant to §404 of the Clean Water Act. Federal Energy Regulatory Commission licenses for hydropower projects. Other federal permits that involve a discharge into Colorado water, including permits issued by the U.S. Environmental Protection Agency (EPA) pursuant to §402 of the federal act.

  • Nationwide Permit Regional Conditions - CO 2021

    The U.S. Army Corps of Engineers, Denver Regulatory Office, through the Regulatory Program, administers and enforces Section 404 of the Clean Water Act (CWA) in the Omaha District portion of Colorado. Under CWA Section 404, a permit is required for the discharge of dredged or fill material into waters of the United States. Many waterbodies and wetlands in the nation are waters of the United States and are subject to the Corps' regulatory authority.
